Passenger suffered back and abdomen injuries in I-270 crash

A woman has filed suit against the driver of the vehicle in which she was riding and the Missouri man who was driving the car that collided with them, claiming she has suffered back and abdomen injuries.

Cynthia M. Brooks says she was riding in a vehicle Tracy A. Brooks was driving east on Interstate 270 at mile post 1 on July 15, 2007, at about 1:31 p.m.

At the same time, Henry Otto Hafner III, who was also driving east, slowed down, resulting in the collision, according to the complaint filed June 11 in Madison County Circuit Court.

In addition to her injuries, Brooks experienced pain, suffering and disability and incurred medical costs, all of which will continue into the future, the suit states.

Hafner negligently drove in an improper and careless manner, stopped or slowed his vehicle and failed to keep driving his vehicle at the minimum speed, the complaint says.

Tracy A. Brooks drove in an improper and careless manner, failed to keep a proper lookout and followed too closely, Cynthia M. Brooks says.

In the two-count suit, Cynthia M. Brooks is seeking an unspecified judgment, plus costs.
