Motions to be heard Wednesday in Troy Center repair negligence case

A motion hearing is set for Wednesday in a 2007 lawsuit over repairs to a Troy commercial center that plaintiffs say are worth over $800,000.

The motion hearing is set for 9 a.m. June 17.

Madison County Circuit Judge Daniel Stack is presiding according to the court docket.

Plaintiffs Daniel and Anita Forguson are suing J&S Construction and Management, Joseph Skowronski and Environs Architects-Planners Inc. for damages related to the repair and renovations of the couple's commercial property, Troy Center.

The couple contends that they hired the companies to repair and renovate the center. Environs drew up the plans and the J&S Construction and Skowronski were involved in the contracting work.

According to the couple's complaint, they signed contracts with the companies for work in 2004. In January 2005, the roof of Troy Center collapsed.

The couple claims the collapse caused in excess of $864,622.08 in damage. They argue that the architects negligently designed an inappropriate roofing structure and the construction company failed to properly reinforce it and construct.

They are suing the three defendants for breach of contract, breach of warranty and negligence. They are seeking more than $850,000, costs and interest.

Action against Environs was dismissed in March.

The case is Madison case number 07-L-718.
