Deckhand claims injuries over defective barge gunnel

A man has filed suit against Inland Marine Service, claiming his right knee was injured after he fell.

Robby Lee Harper says he was working as a deckhand and member of the crew of the JB Klinepeter on June 3 when he fell due to a defect in a barge gunnel.

In addition to his injured knee, Harper says he lost wages, suffered a loss of earning capacity, experienced pain and suffering and incurred medical costs. He also suffered disability, according to the complaint filed April 9 in Madison County Circuit Court.

Inland breached duties to provide Harper with a safe work place, safe equipment and sufficient supervision, the suit states.

In the three-count suit, Harper is seeking a judgment in excess of $100,000 and a judgment of not less than $40 per day for maintenance, plus interest, costs and other relief the court deems just.
