Tooth loss during party tussle leads to suit

A St. Clair County man is suing two other St. Clair County men and a St. Clair County woman over missing teeth he claims he sustained during a fight.

Joshua Anderson filed suit March 6 in St. Clair County Circuit Court, alleging at least one of six minors injured him in a fight at a Nov. 16, 2007, party.

Joshua M. Tipton, a defendant named in the suit, struck Anderson while Penelope R. Blaylock, a minor and another defendant, hit Anderson in the mouth with a beer bottle, "resulting in bodily harm to Plaintiff Anderson, such as Anderson then and there spitting out teeth and severely bleeding from his mouth," the suit states.

Chad A. Bijarro, the third defendant named in the suit, provided the alcohol to the six minors who were attending the party, including Penelope R. Blaylock, the suit states.

"That as a proximate cause of the intoxication of various minors, including but not limited to Blaylock, Plaintiff suffered severe and permanent injuries to his body, including but not limited to loss of several teeth, cuts, bruises, severe pain, swelling and other injuries," the suit states.

In the four-count suit, Anderson is seeking $50,000 and compensatory damages of more than $150,000, plus costs and other relief the court deems appropriate.
