Belleville woman sues O'Fallon woman over accident

A Belleville woman has filed suit against an O'Fallon woman, alleging she was injured after she was forced off the road.

Elizabeth A. Eugea was driving west in the 200 block of West A in Belleville on Aug. 23 when Elizabeth C. McClary, who was also driving west on the same road, forced Eugea to the shoulder, according to the complaint filed Feb. 26 in St. Clair County Circuit Court.

Once on the side of the road, Eugea fell and her motorcycle landed on top of her, the suit states.

Because of the incident, Eugea claims she suffered injuries to her wrist, broken rib, slight concussion and road rash.

She also lost wages, incurred medical expenses, suffered pain and an impaired capacity to work, labor and enjoy the normal pursuits of life, according to the complaint.

McClary was negligent by failing to abide by Illinois laws, by failing to exercise the highest degree of care, by failing to sound a warning of her approach, by traveling too fast, by overtaking and colliding with Eugea and by driving an improperly equipped vehicle, the suit states.

In the two-count suit, Eugea is seeking sums in excess of $100,000, plus costs.

She will be represented by Gerard B. Schneller of Holland, Groves and Schneller and Stolze in St. Louis.

St. Clair County Circuit Court case number: 09-L-0102.
