Cart tire rut on produce is plaintiff's evidence in $100k injury suit

A Madison County woman is suing Shop N' Save over an alleged injury she incurred while shopping at the store.

Janis Pistolis was at Shop N' Save July 11, 2007, when she slipped and fell on a piece of produce that was left on the floor, according to the complaint filed Feb. 24 in Madison County Circuit Court.

The store should have been aware of the produce "as evidenced by a grocery cart tire rut having already marred the produce, on which plaintiff later slipped and fell," the suit states.

Thomas G. Maag and Peter J. Maag of Edwardsville will be representing her.

Because of her fall, Pistolis claims she experienced pain, suffering and disability and incurred medical expenses.

Shop N' Save was negligent by failing to exercise reasonable care to protect her, by stacking the produce in an unstable manner, by failing to properly train employees to remove fallen produce from the floor and by failing to warn Pistolis of the produce, according to the complaint.

Pistolis is seeking a judgment in excess of $100,000, plus additional relief the court deems just.
