Former Pontoon Beach trailer park manager claims retaliatory discharge

The former manager of a Pontoon Beach trailer park claims she was fired from her job because she refused to illegally charge customers for a broken water line.

Kimberly Ormsby was working for Heritage Financial Group, which owned a trailer park at 3801 Lake Drive, when there was a water break, causing a loss of water, according to the complaint filed Feb. 4 in Madison County Circuit Court.

The break was not to an individual trailer owner's water line, but Heritage still tried to force Ormsby to charge individual trailer owners for the expenses of the water leak, the suit states.

Ormsby claims she refused to charge individual owners because it was not legal to do so.

Because of her refusal, Ormsby was fired on Nov. 25, according to the complaint.

"That said firing was in retaliation for plaintiff refusing to do an illegal act, complaining that it was an illegal act and notifying trailer owners of same," the suit states.

Because of her termination, Ormsby claims she has experienced lost wages, pain and suffering, mental anguish and humiliation.

She is seeking compensatory damages in excess of $50,000 and punitive damages in excess of $50,000, plus costs, interest and attorney's fees.
