Shopper seeks $50k from Deals discount store, claiming injuries in trip

A St. Clair County woman has filed suit against a Fairview Heights discount store, alleging her left leg, arm, hand, right shoulder, neck and back were injured after she tripped over a box left in the middle of one of the aisles in the store.

Peggy Anderegg claims she was shopping at the Deals located at 10850 Lincoln Trail when she "was caused to fall and trip over the merchandise that was in the aisle, more particularly, the merchandise box which was left on the floor causing the Plaintiff, Peggy Anderegg, to sustain serious and significant injuries," according to the complaint filed Dec. 4 in St. Clair County Circuit Court.

In addition to her injuries, Anderegg incurred medical costs, sustained great pain and mental anguish, incurred disability and loss of a normal life and lost numerous working days and opportunities, the suit states.

She claims Deals was negligent because it left merchandise and a display box on the floor in the aisle when it knew it would present a danger to people using the aisle, failed to post adequate warning signs warning patrons of merchandise in the middle of the aisle and failed to properly secure the merchandise.

Amderegg is seeking a judgment in excess of $50,000, plus costs.
