Collision caused injuries, woman claims in suit

Virena Durham has filed suit against Amber Winters, alleging she was injured after a collision.

Durham was driving south on Route 159 at its intersection with Ludwig in Fairview Heights on April 11 at about 9:37 p.m. when Winters, who was driving north on Route 159 at the same time, ran a red light while making a left turn and collided with Durham's vehicle, according to the complaint filed Dec. 5 in St. Clair County Circuit Court.

In addition to her head, body and limb injuries, Durham was made sick, sore, lame, disordered and disabled and incurred medical costs, the suit states.

She also claims she suffered disability, experienced pain and suffering, lost wages and will suffer an impairment of future earning capacity.

Winters was negligent because she failed to keep a proper lookout, failed to properly apply her brakes, failed to stop at the red light and yield right of way to approaching traffic, drove too fast and drove without adequate brakes, according to the complaint.

Durham is seeking a judgment in excess of $50,000, plus costs.

John H. Hustava of Collinsville will be representing Durham.

St. Clair County Circuit Court case number: 08-L-626.
