Illinois Power sued by driver claiming injuries in rear-end accident

A St. Clair County woman has filed suit against Illinois Power Company and one of its drivers, alleging she was seriously injured after a rear-end collision.

Minerva Lopez was driving south on Illinois State Route 159 in St. Clair County on Dec. 6, 2006, and was stopped at its intersection with Sandwedge Drive, attempting to turn west onto Sandwedge, when Kevin F. Foley rear-ended her, according to the complaint filed Dec. 4 in St. Clair County Circuit Court.

Foley was driving an Illinois Power Company vehicle at the time of the collision. He damaged both vehicles so much that they had to be towed from the scene, the suit states.

Because of the accident, Lopez claims she endured several diagnostic tests and various pain management and physical therapies and sustained permanent, partial and total disabilities.

She also sustained past and future pain and suffering, mental anguish, inconvenience, physical impairment and a loss of capacity to enjoy life and incurred medical costs, according to the complaint.

Foley and Illinois Power Company, though its employee, were negligent because Foley failed to stop for traffic, failed to keep his vehicle under proper control, failed to reduce his speed to avoid a collision, failed to sound a warning of his approach, to slow down, to swerve or to stop before the collision and failed to keep a constant lookout for other vehicles, the suit states.

In the two-count suit, Lopez is seeking a judgment in excess of $100,000, plus costs and other relief the court deems just.
