Woman sues over Route 111 accident

Virginia Maronie has filed a suit against James Barzee, alleging she was injured after his vehicle "violently" struck hers.

Maronie was driving south on Illinois Route 111 on Oct. 31, 2006, when Barzee, who was driving in the same direction, collided with her, according to the complaint filed Oct. 16 in Madison County Circuit Court.

Because of the accident Maronie suffered neck, back, right side and abdomen injuries, the suit states.

Maronie also claims she has been prevented from attending to her usual duties and affairs and has lost sums of money which would have accrued to her.

She has spent a substantial amount on medical costs, according to the complaint.

Barzee was negligent because he failed to keep a proper lookout, failed to observe Maronie, failed to keep his vehicle under control to avoid hitting Maronie, failed to apply his brakes, failed to decrease his speed to avoid a collision and failed to change course to avoid striking Maronie, the suit state.

In addition, Maronie claims Barzee was negligent because he failed to give proper warning and drove too closely to Maronie.

Maronie is seeking a judgment in excess of $50,000, plus costs.

Michael P. Hickey of Brown and Brown in Fairview Heights will be representing her.

Madison County Circuit Court case number: 08-L-973.
