I-270 accident subject of suit

Patrick Ferrari has filed suit against Stephen John Kenney, alleging he was seriously injured after Kenney's vehicle collided with his truck.

Ferrari was driving his 1997 Chevrolet pickup east on Interstate 270 near mile post 2 in Madison County on Nov. 7, 2006, when Kenney, who was driving his 2000 Ford F-150 pick-up in the same direction, collided with him, according to a complaint filed Oct. 24 in Madison County Circuit Court.

In addition to his injuries, Ferrari spent a substantial amount on medical costs and lost large sums of money, the suit states.

Ferrari claims his earning capacity has also been damaged and that he has incurred physical pain and suffering as a result of the collision.

Kenney was negligent because he failed to see and avoid hitting Ferrari, failed to reduce his speed to avoid a collision, failed to brake or change lanes to avoid a collision, drove too fast and drove in a way that endangered Ferrari's safety, according to the complaint.

Ferrari is seeking a judgment in excess of $50,000 but less than $75,000.
