Alton lawyer sued over car accident

A September 2006 automobile accident is the subject of a personal injury suit filed in Madison County Circuit Court against Alton lawyer Theodore R. Diaz.

The plaintiff, Geoffrey R. Bendorf, alleges Diaz collided with him on East Airline Drive just east of its intersection with Westerholdt Drive in Wood River on Sept. 7, 2006.

According to the complaint filed Sept. 4, Bendorf was driving a 1995 Chevrolet 1500 truck when Diaz, who was operating a 2005 Jeep Cherokee, failed to stop his vehicle in time to avoid colliding with the rear of Bendorf's truck.

Bendorf alleges Diaz disregarded his duty to use reasonable care and caution when he committed the following negligent acts:

  • carelessly driving his vehicle in a reckless fashion in complete disregard for his safety;

  • carelessly failing to exercise ordinary care to avoid a collision;

  • carelessly failing to stop his vehicle in time to avoid striking the rear of his truck; and

  • carelessly failing to keep a proper lookout.

    Bendorf alleges the collision caused him to sustain painful injuries to his neck, back, left shoulder and body that are severe and permanent in nature.

    In addition, Bendorf alleges his injuries caused and continue to cause medical, doctor and hospital expenses and prevent him from attending to his usual duties and affairs that he was able to prior to the collision.

    He also claims his truck sustained approximately $4,000 in damage as a result of the collision.

    Bendorf is seeking a judgment in excess of $15,000, but less than $50,000 and costs of the suit.

    The case is awaiting mandatory arbitration.
