Man claims driver ran over him, left scene

Jeffrey J. Nickell has filed suit against Eric M. Warmack, claiming he was severely injured after Warmack drove over him.

Nickell claims he was holding onto the passenger door of the 1988 Chevrolet S-10 pick up truck Warmack was driving out of the ABC Computers parking lot on Sept. 9, 2006, according to a complaint filed Sept. 8 in Madison County Circuit Court.

He alleges Warmack sped out of the parking lot, which caused Nickell to spin around clockwise and fall underneath the truck.

Warmack drove over both of Nickell's legs and his right arm, then left the scene of the accident while Nickell was still lying on the ground, the suit states.

Nickell sustained permanent scarring to his left leg and right arm and incurred medical expenses, according to the complaint.

He also claims he suffered a loss of income and severe and permanent emotional distress.

Nickell alleges Warmack was negligent because he drove in a reckless fashion, failed to stop in time to avoid running over Nickell, failed to stop when he knew Nickell was holding onto the passenger door, operated the truck when he did not have a valid driver's license and failed to keep a proper lookout.

Nickell is seeking a judgment in excess of $50,000.
