Couple sues contractor over unfinished job

A Swansea couple just wanted to remodel their home, instead they claim they had the contractor from hell.

Eric and Peggy Fankhauser allege they entered into a contract with Briddell Remodeling on June 12, 2007, to remodel their home at 6 Twin lake Court in Swansea.

The couple said they fully performed and complied with all of their obligations. They filed their breach of contract suit July 7, in St. Clair County Circuit Court.

They allege Briddell Remodeling breached the terms of the contract by failing to complete the project as agreed.

According to the terms of the contract, the Fankhauser's had to pay $12,000 upon accepting the contract, $12,000 when the work started, $20,000 when the kitchen was ready to dry wall $10,000 when the wiring was completed and $20,000 when plastering was complete for and $13,863.44 when the work was complete.

The work was to start on Aug. 1, 2007 and be completed by Oct. 1, 2007.

The lawsuit claims the company failed install the closet doors in the living room and finish them to match the walls, failed to replace the carpeting in the closet in the living room, failed to relocate the outlets in the living room, failed to install lighting fixtures in the closet, failed to install a toilet and pedestal corner sink in the powder room, failed to properly frame the door to the powder room, failed to install two base cabinets, with rollout shelves with a countertop in the pantry and kitchen and failed to install countertops.

The Fankhauser's also allege Briddell failed to install a stainless steel kitchen sink with a Kohler, Forte stainless steel faucet, failed to install a backsplash, failed to install a kitchen island to match existing cabinets, failed to properly install the lighting in the kitchen and dining areas, failed to install the kitchen appliances after the kitchen was finished, failed to properly locate the phone and electrical outlets, failed to install a 6010 handrail, failed to remove the carpeting in the master suite, hallway and stairway and install new Cottenfield "Everything Nice" carpet with 21# padding and failed to install tub and shower faucets and make final water connections.

They further allege Briddell failed to install new entry pocket doors to the master bath, failed to install a new master bath countertop with two sinks, failed to install a matching medicine cabinet, failed to install a corner style toilet, failed to install tile in the master bath, failed to install a matching linen cabinet, failed to install the washer and dryer, failed to install a shelf and rod in the laundry area, failed to install a whole house attic fan and failed to perform their work in a workman like manner by Oct. 1, 2007, as stated in the contract.

Represented by B. Jay Dowling of Fairview Heights, the Fankhauser's are seeking a judgment in their favor in excess of $50,000.
