Convenient Food Mart sued over water leak

Roger Elliot of Belleville is seeking in excess of $200,000 in damages for injuries he sustained last year at Convenient Food Mart in Belleville when he slipped and fell on a puddle of water which had leaked from a cold drink cooler.

According to a suit filed April 7 in St. Clair County Circuit Court, the defendants, which include owners Site Oil Co. of Missouri, Equilon Enterprises, Spirit Energy and store manager Steve Vecchetti, were negligent for failing to maintain the premises in a reasonably clean condition.

The incident took place Sept. 16, 2007, at the store located at 9618 West Main St.

Elliot, represented by Bruce Cook of Cook, Ysursa, Bartholomew, Brauer & Shevlin of Belleville, also claims the defendants failed to periodically inspect for the accumulation of foreign substances, failed to warn customers of the presence of water on the floor and failed to remove the water in a timely manner.

Elliot claims he suffered left shoulder and right knee injuries and sustained great pain and mental anguish.
