Dangerous sidewalk lands Alton and water company in court

Mattie Walker-Bennett filed a personal injury suit against the City of Alton and Illinois-American Water in Madison County Circuit Court July 13, seeking damages for injuries she allegedly sustained when tripping on a sidewalk on Alby Street in Alton.

Walker-Bennett claims that on July 21, 2006, she was walking on the sidewalk near 330 Alby Street when she fell due to a dangerous condition on the sidewalk.

According to Walker-Bennett, the dangerous condition consisted of buckled and uneven sidewalk tiles around the water meter located near the sidewalk.

"The sidewalk tiles were installed in such a manner as to allow them to buckle and become uneven creating a dangerous condition and causing the plaintiff to fall," the complaint states.

She claims the defendants failed to maintain the sidewalk in a safe manner, failed to warn of the dangerous condition and failed to maintain a safe means of passage for pedestrians on the sidewalk.

Walker-Bennett claims she sustained severe, permanent and progressive injuries to her right ankle and foot, suffered pain, stress, anxiety, fear, humiliation, frustration and embarrassment.

Represented by Jamie Boock of Rossiter, Reed & Boock of St. Louis, Walker-Bennett is seeking damages in excess of $200,000, plus costs and prejudgment interest.

The case has been assigned to Circuit Judge Daniel Stack.
