Man seeks $50k from Wal-Mart for tripping on battery

A man who tripped over a battery at the Highland Wal-Mart filed a personal injury suit in Madison County Circuit Court Nov. 29, seeking damages in excess of $50,000.

Represented by Terrance O'Leary of Granite City, Jerome Hogan claims that on Sept. 28, 2003, he sustained numerous and permanent injuries to his cervical and lumbar spine.

According to Hogan, the battery he tripped over had been placed on the floor adjacent to the service desk causing him to fall and strike the wall and an anti-theft device.

Hogan claims Wal-Mart negligently and carelessly failed to maintain or keep its premises in a safe and proper condition, failed to warn him of the battery and failed to move the battery after observing the placement in the vicinity of the service desk.

He claims the fall caused him to sustain great pain and suffering, medical expenses, lost wages and the loss of an ordinary life.

The case has been assigned to Circuit Judge Nicholas Byron.
