FELA suit in federal court names ICR

An Arkansas man who was injured in Memphis and is getting medical treatment in St. Clair County, filed a Federal Employers' Liability Act suit in District Court March 31 against Illinois Central Railroad.

Seeking damages in excess of $75,000, Robert Harrell, Sr. claims that on April 3, 2003, ICR negligently failed to warn him of an approaching train in time to avoid a collision and ordered him to operate a locomotive engine without warning of an on-coming approaching train.

Harrell also claims ICR failed to provide him a reasonably safe place to work, failed to provide a safe method of work and failed to maintain and inspect the hand brakes of its locomotives.

According to the complaint, Harrell suffered injuries to the muscles, tendons, ligaments, nerves, joints and soft tissues of his shoulders which caused pain and suffering, lost wages, disfigurement and disability and h as become liable for medical expenses.

Harrell also claims he aggravated a pre-existing condition.

He is represented by John Kujawski of O'Fallon. The case has been assigned to District Judge William Stiehl and Magistrate Judge Clifford Proud.
