Willow Creek targeted in neglect suit

Willow Creek Rehabilitation and Nursing Center

The guardian of Tommie Stainback filed suit against Willow Creek Rehabilitation and Nursing Center claiming that the Belleville nursing home failed to care for Stainback in a manner which maintained and enhanced his health and dignity.

Ramona McNamee claims that on July 9, 2005, Stainback fell from his bed at Willow Creek sustaining trauma to his face, including a nasal fracture, and numerous lacerations and bruises.

According to the complaint, Stainback was receiving personal care from a certified nurses assistant at the time of the alleged fall.

McNamee also claims that in July of 2005, Stainback developed severe decubitus ulcers while at Willow Creek.

She claims that Willow Creek failed to employ enough staff to provide adequate medical or personal care to Stainback, failed to timely report the abuse, neglect, or injury to the Department of Public Health, and failed to address Stainback's significant physical, mental and psychosocial decline in its initial care plan meeting.

McNamee also claims Willow Creek negligently violated its own resident care policies by failing to provide necessary care and services to Stainback and by failing to provide a follow-up assessment after his fall to determine the extent of his injuries and to prevent future injuries to him.

She claims that Stainback suffered a marked deterioration of his prior physical condition, suffered great pain and anguish as a result of his injuries, and has become liable for medical expenses associated with his injuries.

Represented by Robert Gregory of East Alton, McNamee is seeking damages in excess of $200,000 plus all costs of the suit.
