Movie-goer sues for tripping on sidewalk
Dorothy Banes of Granite City is seeking damages in excess of $50,000 from Wehrenberg Inc. because she fell on a sidewalk at the O'Fallon 15 Cine two years ago.
In a suit filed Feb. 7 in St. Clair County, Banes claims she has experienced pain and suffering and incurred medical bills from the incident that took place Feb. 8, 2004. She does not specify her injuries.
Represented by Bill T. Walker and Emily E. Epperson of Granite City, Banes claims she stepped on an uneven surface of the sidewalk.
She claims it was the duty of O'Fallon Cine 15 to keep the premises in a reasonably safe condition.
"Defendant O'Fallon 15 Cine allowed and permitted the surface of the sidewalk outside the cinema to remain in an unsafe, defective, dangerous and improper condition," the complaint states.
