Mildred Parker's suit against Casey's General Store in Alton alleging that an employee ran over her daughter's left foot with a floor buffer will be in court Jan. 6 for all pending motions.
Circuit Judge Andy Matoesian will preside over the hearing at 9 a.m.
According to the suit filed July 26, 2005, in Madison County Circuit Court, Parker claims the incident took place April 30, 2005, as her daughter was walking in an aisle.
Casey's was negligent because the employee operated the buffer in a reckless manner and failed to keep a proper lookout for patrons in the store, she claims.
Bones, ligaments, nerves and muscles in her daughter's left foot were "greatly broken," crushed and displaced, which has hindered her from attending to her normal duties, Parker claims.
Parker is represented by Joseph Hoefert of Alton. Casey's is represented by Doug Teasdale of St. Louis.
The case is set for a jury trial on Oct. 6, 2006.
