Norfolk Southern's forum non conveniens motion set for hearing

Norfolk Southern Railway filed a motion to dismiss a Federal Employers’ Liability Act (FELA) suit based on forum non conveniens on June 16 in Madison County Circuit Court.

Lawrence Jones filed the suit March 30 claiming he was injured on three separate occasions in 2002 while working for Norfolk Southern in Chattanooga, Tenn.

According to the complaint, Jones sustained severe and permanent injuries to his neck, back, spine, shoulders and body, all of which have and will cause him to suffer great pain and mental anguish.

Jones claims that the railroad failed to provide him with a safe place to work, failed to provide him with safe methods to work, failed to provide sufficient manpower and failed to provide him with safe tools and equipment.

The complaint does not state where Jones resides, but claims Norfolk Southern does business in Madison County. Jones is represented by Gregory Tobin of Pratt & Tobin of East Alton.

Norfolk is represented by Thomas Alvey of Thompson Coburn in Belleville. Circuit Judge George Moran, Jr. has set a hearing on July 14 at 9 a.m. in courtroom 320.
