Cahokia nursing home named in SCC court action

River Bluffs of Cahokia Nursing & Rehabilitation Center is being sued for negligence by the estate of Nancy Maston, who died Feb. 9, 2004.

According to the suit filed May 11 in St. Clair County Circuit Court, Maston suffered recurrent urinary tract infections, malnutrition, dehydration, decubitus ulcers and abdominal wall cellulitis from May 2003 until the time of her death. She was a resident from Oct. 7, 2002, until May 13, 2003.

Loretta Maston, acting as the estate administrator, has hired Staci Yandle of The Rex Carr Law Firm of East St. Louis as plaintiff attorney. The four-count suit seeks in excess of $150,000 for alleged violations of the Nursing Home Care Act.

Bassam Albarcha, M.D. is included in the suit as a “respondent-in-discovery because the plaintiff believes this defendant has information essential to the determination of who should be properly named as additional defendants,” according to the suit.

Nursing home owners Moshe and David Aryeh also are named in the suit for allegedly failing to operate the facility “in a manner so as to protect Nancy Maston from neglect.”
