Construction worker sues for skin conditions

Construction worker Kenneth Fields is suing Jay Henges Enterprises Inc. for spraying a “certain material” which caused him to suffer from folliculitis, dermatitis, malaria rubra and purig nodularis.

Represented by David Nissenholtz of St. Louis, Fields filed suit in St. Clair County Circuit Court seeking in excess of $50,000.

The substance that allegedly caused Fields to sustain serious and permanent injuries was not named in the suit. The incident took place at a construction site in St. Clair County in May 2003.

“(Defendants) negligently and carelessly failed to warn plaintiff that they intended to spray the aforesaid material and knew or should have known that doing so was dangerous and not reasonably safe under the circumstances,” the complaint states.
