Woman sues after falling to the ground

Fitness Designs Physical Therapy and Sports Rehab in Edwardsville

Carla Jane Johnson, who fell to the ground after the physical therapy equipment she was using at home malfunctioned, is suing Fitness Designs Physical Therapy and Sports Rehab and its president, Michael Pohlman, for injuries to her right elbow, right arm, and other portions of her body.

Johnson filed a three-count personal injury suit May 3 in Madison County Circuit Court, claiming the defendants failed to properly maintain their "Thera-band" equipment and did not warn her of potential danger. She was undergoing therapy at Fitness Designs for rotator cuff tendonitis.

According to the complaint, Johnson was instructed to use the Thera-Band at home and during the course of the treatment on May 6, 2003, the device broke causing her to fall.

Johnson also alleges she suffered and will continue to suffer great pain and mental anguish, past and future medical expenses for the treatment of her injuries, property damages, and lost wages from her usual employment.

Johnson is represented by Patrick Foley of Becker, Paulson, Hoerner & Thompson of Belleville.

The case has been assigned to Circuit Judge Nicholas Byron.
