In a complaint lodged against Applied Food Biotechnology, Innova and Griffith Laboratories, an employee of Petra Industries in Fairmount claims his central nervous system was damaged by chemical exposure.
Kyler Updyke's three-count suit filed April 15 in St. Clair County Circuit Court, seeks in excess of $45,000. He claims he was injured May 9, 2003.
The complaint alleges that defendants were negligent for shipping improperly labeled products to Petra Industries and failing to provide a proper product analysis.
Updyke, represented by Grey Chatham of Swansea, claims lost wages, medical expenses, physical and emotional injuries and permanent disability.
