Fraud alleged against home builder

117 Prairie Manor Drive in Edwardsville

Edmund and Allison Hershberger filed suit against the builders of their Edwardsville home alleging the defendants, Ricky Pinkston and Tanya Cook-Pinkston, entered into a contract with the intent to deceive them.

The property is located at 117 Prairie Manor Drive in Edwardsville.

According to the complaint, the Hershbergers claim that the Pinkstons made false representations about the home's condition in a suit filed April 8 in Madison County Circuit Court.

The Hershbergers allege their roof leaks, the siding of the house is not properly installed, the basement leaks, the home's sump pump piping is incorrectly installed, gutters were not installed, the air conditioning needs to be upgraded, the concrete porch slab is sinking, there is a hole in the garage wall, plumbing and toilets are improperly installed and the chimney does not draw smoke from the house, making the fireplace unusable.

As a result, the Hershbergers claim they have been damaged in an amount in excess of $50,000 plus costs of the suit. They also are seeking punitive damages in the amount of $150,000, claiming the actions of the defendants were willful and wanton or intentional and subject the defendants to punitive or exemplary damages.

Represented by Edward McCarthy of Edwardsville, the Hershbergers are also seeking $50,000 in damages for repairs that will be needed to fix the house.

The case has been assigned to Circuit Judge Andy Matoesian.
