A Marion County man filed suit against an Olathe, Kan. resident--over a car accident that occurred in Effingham County--in St. Clair County Circuit Court on Feb. 11.

Terry Lingle of Salem alleges that Clark Yorton (of Olathe) pulled into the path of his vehicle causing a collision on Feb. 18, 2003, on Thelma Keller Street in Effingham, causing him permanent and progressive injuries.

Lingle claims that as a result of Yorton's negligence, he injured his left shoulder, back and "structures thereof."

Represented by Brown and Crouppen of St. Louis--a regular advertiser on local television--Lingle is seeking damages in excess of $50,000 plus costs and expenses.

The suit states that Lingle's body has been "seriously bruised, contused, lacerated, cut, torn, swollen, aggravated, ruptured, mashed, wrenched, narrowed, compressed, subluxed, abraded, dislocated, strained, sprained and rendered stiff, sore and painful."

According to the complaint, Yorton drove dangerously and at a high rate of speed and failed to exercise ordinary care, nor kept proper lookout.

Yorton "failed to give or sound any signal or warning of the approach, movement, or turn of his vehicle," the suit states.

Lingle claims he has suffered great physical pain and the functions of all his injured areas have been and will continue to be greatly impaired and diminished and that all of his injuries are permanent and progressive.

Lingle is also seeking damages for medical expenses from medicines, doctors, x-rays, and hospitals and will in the future be required to spend money which the exact amount cannot be definitely ascertained at this time.
