A New York banking institution has sued a Highland couple and its medical practice, alleging money is owed for the lease of equipment.
Manufacturers and Traders Trust Co. filed a lawsuit March 11 in Madison County Circuit Court against Greenville Gastroenterology, Peter S. Kim and Angela R. Kim, citing breach of contract.
Manufacturers and Traders Trust Co., a bank operating in New York and doing business in Illinois, is the successor by merger to a company known as Court Square Leasing Corp. According to the complaint, DeLage Landen Financial Services, which ultimately assigned the debt to Court Square Leasing, entered into a lease agreement with Greenville Gastroenterology and the Kims on May 31, 2007, for the lease of a Cutera Full XEO laser.
The suit states that on Dec. 27, 2007, Court Square Leasing took ownership of the lease, and Greenville was supposed to make 72 monthly payments of $3,226.93, but stopped doing so in September 2009 after making 21 payments, which means the company still owes principal of $155,948.
The plaintiff seeks a total of $204,194.95, which includes the principal amount, late fees, attorney fees and court costs. It is represented by Ehrenberg and Egan in Chicago.
