Couple files lawsuit against bar and patron, claiming injuries in attack

A man claims he sustained injuries after an intoxicated patron violently attacked him at an Alton bar.

John Swengrosh and Patricia Swengrosh filed a lawsuit Feb. 6 in Madison County Circuit Court against N&M Pub Room, Nicole Cox, Michael Cox, Jaybird Revocable Trust and the estate of Richard W. Rodden.

In their complaint, the Swengroshes allege John Swengrosh was patronizing N&M Pub Room on Feb. 16, 2014, when Rodden violently assaulted him.

Because of the attack, John Swengrosh sustained injuries and disfigurement, experienced pain and suffering and incurred medical costs, according to the complaint.

His wife, Patricia Swengrosh, lost her husband's companionship because of the incident, the suit states.

The Swengroshes name the management of N&M Pub Room as defendants, saying they negligently failed to provide security personnel to screen violent people at the door, failed to provide a safe place to drink and socialize, failed to prepare and implement a security plan and failed to organize a security force to control patrons, among other negligent actions.

In their complaint, the Swengroshes are seeking a judgment of more than $500,000, plus costs.

They will be represented by Jane Unsell of Unsell, Schattnik and Phillips in Wood River.

Madison County Circuit Court case number: 15-L-143.
