Bouncy toy caused minor son's injuries, according to complaint

A mother alleges her child sustained leg injuries while playing on a bouncy toy at Monkey Joe's.

Elizabeth Toepfer alleges her son, Robert Toepfer Jr., was playing on a bouncy toy at defendant MJ Fairview Heights at 10855 Lincoln Trail in Fairview Heights on April 13, 2013, when his leg became entangled in a tear.

Due to the incident, Robert Toepfer Jr. became sick, sore, lame, disordered and disabled and received leg injuries, according to the complaint filed Nov. 7 in St. Clair County Circuit Court. In addition, he incurred medical costs, suffered disability and disfigurement and experienced pain and suffering, the suit states.

MJ Fairview Heights negligently failed to properly inspect the bouncy toys and allowed a rip to exist in the toys, the complaint says.

In her complaint, Elizabeth Toepfer seeks a judgment of more than $50,000, plus costs.

Kirk A. Caponi, of the Law Offices of Williams, Caponi and Associates in Belleville, will represent Taylor.
