A Fairview Heights woman is being accused of running a stop sign and colliding with a Belleville woman’s vehicle, causing internal and external injuries.
Plaintiff Markita T. Farmer of Belleville filed the lawsuit against Avia L. Williams of Fairview Heights on Oct. 31 in the St. Clair Court Circuit Court.
According to the complaint, the collision occurred on Nov. 6, 2012, when Williams was driving her vehicle on Old Lincoln Trail at its intersection with St. Clair Road in Fairview Heights. At the same time, Farmer was driving northbound on St. Clair Road.
The plaintiff claims she proceeded through the intersection with the right of way after making a complete stop when Williams collided with the vehicle, the suit states.
Farmer claims it was the defendant’s duty to use reasonable care and caution for the safety of others when operating her vehicle.
Farmer accuses Williams of negligence for failing to keep a proper look out for the plaintiff and other traffic on a public roadway; failing to keep the vehicle under proper control; negligently and carelessly colliding with Farmer’s vehicle; failing to stop, swerve or otherwise maneuver the vehicle in order to avoid a collision, failing to make a complete stop at the four-way stop before entering the intersection, failing to yield the right of way before entering the intersection, failing to see and observe the plaintiff and failing to stop the vehicle in time to avoid an accident.
Farmer alleges she sustained severe and permanent injuries both internally and externally to numerous parts of her body and nervous system causing her to suffer “great pain and anguish.” She claims to have expended and will continue to expend “large sums of money” in medical expenses for the treatment of her injuries.
She also claims she lost wages and has been damaged in her future earning capacity as she will continue to lose wages in the future as a result of her injuries, according to the complaint.
Farmer seeks a judgment of more than $50,000, plus costs of the suit and any other relief the court deems just and proper.
