Collinsville woman alleges she fell off ladder at YMCA

A Collinsville woman claims she was injured after falling off a ladder at the Edwardsville YMCA after the defendant left the item at the facility for employees to use.

Plaintiff Jan Wallace of Collinsville filed the complaint against Toenjes Brick Contracting, Inc., on Oct. 24 in the St. Clair County Circuit Court.

According to the complaint, Wallace was using a ladder owned by Toenjes Brick Contracting, which had been left at the Edwardsville YMCA on Oct. 31. While using the ladder, a portion of the ladder fell due to damage allegedly caused by use and abuse by the defendant’s agents, causing the plaintiff to sustain injuries.

The defendant is accused of negligently and carelessly supplying the ladder to YMCA of Edwardsville for its use knowing it to be in a state of disrepair and in a dangerous condition; failing to warn employees and users of the ladder and leaving behind the dangerous and defective ladder at issue after performing certain repairs at the facility for employees to use, the suit states.

Wallace claims she sustained injuries to her legs, head, neck and spine (including disc injuries), causing her to incur medical costs and suffer disfigurement and disability.
She alleges she experienced pain and suffering and believes she will experience pain and suffering in the future, causing her to lose wages and suffer an impairment of future earning capacity.

Wallace seeks a judgment of more than $50,000 plus costs of the suit.
