Fischer Lumber Co. sues construction company claiming breach of contract

Fischer Lumber Company is suing a construction company and the owners after they allegedly failed to repay a debt.

Fischer Lumber Company filed a lawsuit June 13 in the Madison County Circuit Court against Kenneth P. Karlas, Kathy Karlas and Karlas Construction Co. Inc., citing breach of contract.

The plaintiff alleges it entered into an agreement for the sale of goods in the amount of $6,047.93 with the defendant in September. According to the complaint, the defendant has failed to pay the money due the plaintiff under the contract. The suit alleges the defendants agreed to pay the plaintiff the sum of $56,535.83 in monthly payments beginning Sept. 15, 2012, of which the defendants have failed to pay $49,258.03.

The plaintiff is seeking damages in the amount of $58,305.96 and court costs.

It is being represented in the case by Godfrey attorney John W. Hoefert Jr.
