Centreville food warehouse sued by client claiming product ruined by rodents

Fresh Warehousing has been named in a negligence and fraud claim after a client's food was allegedly ruined by rodents.

SensoryEffects Flavor Company filed a lawsuit May 8 in the St. Clair County Circuit Court against M.J. Resurrection Inc., doing business as Fresh Warehousing, citing breach of contract, negligence and fraud.

The plaintiff claims it entered into an agreement with the defendant to store food grade items in its warehouse in Centreville on Jan. 3, 2013. The suit alleges the defendant claimed its facility was a food grade warehouse, although when the plaintiff's employees inspected the loads stored in the warehouse they discovered animal feces and rodent chew marks on several bags of product. According to the complaint, the loads weren't kept in a controlled environment. Consequently, its product was rendered worthless and a total loss.

The plaintiff is seeking judgement in the amount of $159,601.53 and court costs. It is being represented by St. Louis attorney David S. Corwin.
