Four Points Roofing sues over non-payment

A St. Clair County roofing company is suing various entities for non-payment of hail damage repairs made to a Collinsville property.

Four Points Roofing & Siding Co., a division of M.O.M. Distributing Inc., filed a lawsuit April 14 in the St. Clair County Circuit Court against Richard L. and Kathryn A. Toon, St. Clair Aluminum and Construction Incorporated and unknown owners and necessary parties, citing breach of contract.

According to the complaint, on July 12, 2012, the Toons contracted Four Points to perform improvements to their property on Ponderosa Hills Lane in Collinsville for $71,500, and Four Points subcontracted St. Clair Aluminum to perform roofing work on the property. Four Points says the Toons received $48,000 from their insurers for hail damage to the roofs of several barns, but have failed to pay any of the total balance for the work performed.

Four Points is seeking a mechanic's lien for the $71,500 owed and preference for its lien over that of St. Clair Aluminum and Construction.

It is being represented in the case by attorney Shane M. Moskop of Freeark, Harvey & Mendillo P.C.
