Wal-Mart removes worker's FMLA case to federal court

Wal-Mart has removed to federal court a lawsuit filed by a 70-plus year old worker who alleges he lost his job after he filed for time off under the Family and Medical Leave Act.

The store's attorneys at Barnes and Thornburg in Indianapolis removed the case filed by plaintiff Raymond Bohnenstiehl on March 26.

In his suit filed Feb. 7, Bohnenstiehl claims he had been working for the Collinsville Wal-Mart store since April 21, 1998, and requested time off under the Family Medical Leave Act. He claims that he was fired on April 4, 2012. At the time he was fired, Bohnenstiehl was 70 years old and was replaced by an employee who was younger than 40,  his suit states.

Because of his job loss, Bohnenstiehl claims he suffered emotional distress, mental anguish, pain and suffering and inconvenience and lost his enjoyment of life. He also lost wages and benefits, according to the complaint.

Bohnenstiehl seeks a judgment of more than $350,000, plus costs.
