Motorcycle collision caused injuries, suit says

Two Illinois residents claim they suffered various injuries after a driver struck the motorcycle on which they were riding.


Todd and Margaret Libbra filed a lawsuit March 10 in the St. Clair County Circuit Court against Devin Vice.

In their complaint, the Libbras claim Todd Libbra was driving his 2003 Harley Davidson south on Route 159 in Smithton on March 25, 2013, when Vice, who was driving a 1999 Dodge south on the same road, struck the motorcycle.

Because of the collision, Todd Libbra sustained injuries to his head, eye and wrist while Margaret Libbra suffered injuries to her head, neck and brain, according to the complaint. Both Libbras also suffered great pain and mental anguish, incurred medical costs and lost money because of their inability to pursue their normal occupations, the suit states.

The Libbras blame Vice for causing the collision, saying he failed to yield to traffic, failed to keep a proper lookout, turned left into oncoming traffic and failed to reduce his speed to avoid a collision.

The Libbras are seeking a judgment of more than $100,000, plus costs. They are being represented by Gregory L. Shevlin of Cook, Ysursa, Bartholomew, Brauer and Shevlin in Belleville.
