A Madison County couple has filed suit against the company that installed a metal roof, alleging their home has experienced recurring leaking problems and has required a second complete roof replacement.

Robert and Rebecca Jones filed a lawsuit Feb. 25 in the Madison County Circuit Court against Metals USA Building Products and Nexgen Green Products.

In their complaint, the Jones allege they hired Nexgen to install a stone coated metal roofing system on their home for $28,900. The installation was finished on Nov. 20, 2010, but the Joneses discovered problems with the roof on Oct. 9, 2011, according to the complaint. For instance, the roof was installed with an insufficient number of fasteners and was not in compliance with the manufacturer’s installation instruction, the suit states. In addition, it had begun to rust and was leaking over a back porch area, the complaint says.

The Jones contacted Nexgen. In turn, a representative from Metals USA informed the couple that the roof had not been properly installed, they claim. Representatives from Metals came to the Jones’ home to inspect the roof on Jan. 11, 2012, and promised to ensure proper installation of the roof, according to the complaint.

In or about June 2012, Metal USA’s territory manager, James DeVelder, made an agreement whereby Nexgen would tear down the back section of the roof, repair the pitch change, the valleys and flashing at the chimney and roof to the wall, the suit states.

However, the Jones claim they received detrimental advice from a different roofing company. The outside installer informed the Jones their entire roof would have to be removed, including a shingle roof underneath, and a new steel roof would have to be installed at a price of more than $30,000, according to the complaint.

Because of the way the original roof was installed, the Jones have suffered from a leaking roof, which must be removed and replaced, the suit states.

The Jones are seeking a judgment of more than $150,000, plus costs and other relief the court deems just. They are being represented by Bill T. Walker of Granite City and James E. Parrot of St. Louis.
