An Oklahoma woman has filed suit in St. Clair County against the drug company she claims manufactured a contraceptive system that migrated within her body.

Jamie Deckard filed suit Jan. 30 against Bayer Healthcare Pharmaceuticals Inc.

The plaintiff claims the contraceptive Mirena, which is manufactured by defendant Bayer, moved from its proper position within her body, necessitating the removal of the device and causing her injuries. Because of the device’s movement, the plaintiff claims she suffered permanent injuries, endured physical pain and suffering and experienced mental pain. She also lost her enjoyment of life, incurred medical costs and lost her earnings and earning capacity, according to the complaint.

The plaintiff alleges design defect, negligence, failure to warn, breach of implied warranty, breach of express warranty, misrepresentation by omission, fraudulent misrepresentation and breach of implied warranty.

The plaintiff is seeking damages of more than $350,000, plus costs, attorneys’ fees and other relief the court deems just.

She is being represented by John J. Driscoll and Gregory J. Pals of The Driscoll Law Firm in St. Louis and Douglas P. Dowd and William T. Dowd of Dowd and Dowd in St. Louis.
