Fairview Heights accident blamed on following too closely

Two people have filed suit against the drivers who they claim caused a multi-car collision, causing them to experience pain and suffering.

Michael Jarvis claims he was driving north on Highway 159 in Fairview Heights on March 18, 2012, when defendants Richard Hayes, Brenda Johnson and Sondra Smith, who were driving in the same direction, caused a collision after failing to keep a proper lookout and making a sudden stop. At the time of the collision, plaintiff Sheila Zavala was riding as a passenger in the vehicle, according to the complaint filed Nov. 22 in St. Clair County Circuit Court.

Due to the accident, Jarvis and Zavala experienced pain and suffering, endured disability and disfigurement, incurred medical costs and lost income, the suit states. They also incurred property damages and are at an increased risk for future injury, the complaint says.

They blame the defendants for causing the collision, saying they negligently failed to keep a proper lookout, followed vehicles too closely, failed to reduce their speeds to avoid a collision, drove too fast and made a sudden stop.

In his complaint, Jarvis is seeking a judgment of more than $300,000, plus costs.
