A woman has filed suit against her doctor, saying the doctor failed to offer a C-section, causing the woman to endure severe pain when she suffered from tearing during the birth of her child.
Abby Bradshaw claims she gave birth to her child on Jan. 19, 2012. During the birth, Abby Bradshaw suffered a third-degree extension tear after defendant Dr. Patrice Staten failed to offer a Cesarean section delivery, according to the complaint filed Dec. 5 in Madison County Circuit Court.
Because of the incident, Bradshaw has continued to experience pain and suffering; sustained mental anguish, disfigurement and disability; and lost her enjoyment of life, the suit states. She also lost wages and incurred medical costs, the suit states.
Abby Bradshaw blames Staten for contributing to her injuries, saying Staten failed to inform her of the possibility of complications of a vaginal delivery, in addition to failing to provide her with the option of a C-section.
In addition to Staten, the Bradshaws name Distinctive Care for Women as a defendant, saying it is liable for her injuries because it hired Staten.
In their complaint, the Bradshaws are seeking a judgment of more than $200,000, plus costs.
