Woman blames F350 driver for making right turn into her car

A woman claims she suffered chest, left hip, left leg, left shoulder and left arm injuries after a driver collided with her vehicle while attempting to make a right hand turn.

Misty Endicott-Spivey filed a lawsuit Nov. 18 in St. Clair County Circuit Court against Brian G. Stone.

In her complaint, Endicott- Spivey claims she was driving a 2007 Ford Freestyle east on West Main Street in Belleville on Sept. 14, 2012, when Stone, who was driving a 1997 F350 in the same direction, attempted to make a right-hand turn and struck Endicott-Spivey’s vehicle.

In addition to her injuries, Endicott- Spivey became sick, sore, lame, disordered and disabled; incurred medical costs, suffered disability, lost her normal life, experienced pain and suffering and lost wages, according to the complaint.

She blames Stone for causing the collision, saying he negligently failed to reduce his speed, failed to keep a proper lookout, failed to keep his vehicle under proper control, failed to stop or swerve to avoid a collision and drove too fast.

In her complaint, Endicott-Spivey seeks a judgment of more than $50,000, plus costs.

David C. Nelson of Nelson and Nelson in Belleville will be representing her.

St. Clair County Circuit Court case number: 13-L-585.
