China King driver sues employer and driver over head-on crash in Belleville

A restaurant delivery driver says he was hurt when he was allegedly hit head-on by another driver while delivering food in Belleville.

Shawn Cagle filed a lawsuit Oct. 1 in St. Clair County Circuit Court against Lance Drew and China King LLC.

Cagle says the crash happened while he was on a delivery run for China King in December 2010. While driving west on West Main Street Cagle says he pulled his Chevrolet Cobalt into the center turn lane near the intersection of 98th Street. At the same time, Drew was driving east on West Main Street and allegedly swerved his car into the turn lane, crashed into Cagle. He says the impact forced his Cobalt off the road and into a nearby cemetery.

Cagle accuses Drew of negligence for failing to maintain his lane of travel. He also accuses China King of negligence for failing to provide workers’ compensation insurance coverage, a violation of the Illinois Workers’ Compensation Act. Cagle asks for more than $100,000 in damages for medical care costs, lost income and court fees.
