An O’Fallon real estate company says a neighbor of one of its properties trespassed when it put up a sign on its lot.
Commercial Real Estate Investors filed a lawsuit Sept. 12 against Drury Development Corporation in St. Clair County Circuit Court.
CREI owns a property located on the 1100 block of Central Park Drive in O’Fallon, according to the complaint. The adjacent parcel is owned by Drury Development. In March 2006 CREI says it began negotiations with Drury Development for an easement onto CREI’s property. Drury Development allegedly wanted to put up a sign on the plaintiff’s lot to advertise its hotel business.
After extensive discussions, CREI says, the two companies were unable to come to an agreement on an easement. However, in November 2006, CREI says Drury Development installed a sign on its property without permission. Despite many alleged requests to remove the sign, CREI says Drury Development has yet to do so.
CREI accuses Drury Development of trespass for the last six years and asks for more than $50,000 in damages and court fees.
