The owner of a Granite City roofing company has filed a motion to dismiss a lawsuit that accuses him of failing to pay an insurance premium.
Liberty Insurance Corporation filed a lawsuit Nov. 8 against Ronald Ryan.
Ryan, doing business as Ryan Roofing, filed the motion to dismiss on Dec. 20, stating that Liberty’s complaint never alleged Ronald Ryan was doing business as Ryan Roofing.
The motion also says the summons served on Ronald Ryan does not confer personal jurisdiction over Ronald Ryan.
According to the complaint, Liberty Insurance agreed to issue a policy to Ryan Roofing that ran from July 2008 through July 2010. The insurance carrier says it performed an audit at the end of the term and determined an additional premium was required from Ryan Roofing. Liberty alleges the roofing company and its owner agreed to the terms of the policy but has refused to pay the premium, a total of more than $250,000.
Liberty Insurance asks to be paid the balance of the premium plus interest and court costs.
Neal J. Wallace entered his appearance as attorney for Ryan on Dec. 20.
The insurance provider is being represented by attorney Mark A. Brueggemann of Collinsville.
