In its answer to a slip and fall lawsuit, Home Depot claims a plaintiff who alleges she tore her Achilles tendon at its Belleville store was negligent for her own injuries.
Virginia Enlow of Smithton alleges she tripped over an obstacle at the store on June 3, 2010. She sued in St. Clair County Circuit Court on Nov. 8.
Colleen Tierney entered her appearance as defense attorney for Home Depot on Dec. 14.
Home Depot also claims in its answer that Enlow failed to take reasonable evasive action; failed to exercise ordinary care in the position she occupied at the time of the occurrence alleged in the complaint; and was otherwise careless and negligent.
In addition to her torn tendon, Enlow claims she incurred medical costs; experienced pain, suffering and disability; and lost wages, according to the complaint.
In addition to Home Depot, Enlow names the store’s manager, Erin Dietrich, as a defendant, alleging she failed to train employees to maintain safe walkways for customers.
Enlow is seeking a judgment of more than $50,000.
