A St. Clair County man blames DirecTV and its employee for causing his wedding band to break, saying the ring sustained damages after he tripped over a DirecTV employee’s toolbox and fell.

Roger Wegener filed a lawsuit Dec. 2 in St. Clair County Circuit Court against DirecTV, DirecTV Home Services, the DirecTV TV Group and DirecTV employee, Brad Johnson.

In his complaint, Wegener claims he purchased television services from defendant DirecTV. Defendant Brad Johnson had arrived at Wegener’s home to install DirecTV when Johnson left a toolbox on the staircase, leading to the incident in question, according to the complaint.

Because of Wegener’s subsequent tumble down the stairs, he sustained injuries to his left shoulder, left elbow, hands, fingers, left leg, left ankle, left knee, pelvis, abdomen, back and spine, the suit states. He also experienced great pain and mental anguish; became sick, sore, lame, disordered and disabled; incurred medical costs; lost wages; and incurred property damages, including costs to replace his wedding ring, which broke during the fall, the complaint says.

Wegener blames Johnson for causing his fall, saying the DirecTV employee negligently failed to keep his equipment in a safe place, created a tripping hazard by placing his equipment on the stairs, failed to move his equipment when Wegener opened the basement door and failed to warn Wegener that he would be placing his toolbox on the stairs.

In his four-count complaint, Wegener seeks a judgment of more than $200,000, plus costs.

William J. Niehoff, Mark S. Schuver and Laura E. Craft of Mathis, Marifian and Richter in Belleville will be representing him.
