A man claims he sustained a broken nose after a driver rear-ended his vehicle as he slowed for traffic.
Preston and Laura Bogard filed a lawsuit May 19 in St. Clair County Circuit Court against Betty Krupp.
In their complaint, the Bogards allege Preston Bogard drove south on Route 159 near County School Lane in Smithton on May 22, 2009, when he stopped for traffic. Suddenly, Krupp, who drove in the same lane, struck the back of Preston Bogard’s vehicle, according to the complaint.
In addition to his fractured nose, Preston Bogard sustained injuries to his back, neck, face and head and suffered from facial lacerations and facial scarring, the suit states. He also suffered from headaches, suffered great pain and disability and lost his normal life and wages, the complaint says.
At the time of the collision, Laura Bogard rode as a passenger in Preston Bogard’s vehicle.
Because of the collision, she claims she suffered neck, back, shoulder, head and jaw injuries; suffered from headaches; incurred medical costs; experienced great pain, suffering and disability; and lost her normal life.
The Bogards blames Krupp for causing the collision, saying she negligently drove without keeping a proper lookout, drove too fast, failed to stop to avoid a collision, followed their vehicle too closely and collided with the rear of a vehicle.
In their two-count complaint, the Bogards seek a judgment of more than $50,000, plus costs and other relief the court deems just.
